2. Scope

These General Terms and Conditions of Sale, hereinafter referred to as the “Terms and Conditions,” govern all sales concluded through the Les Bijoux du Nibou website between:

and any individual acting for purposes outside their trade, business, craft, or profession, hereinafter referred to as the “consumer” or the “Customer.”

These Terms and Conditions are available to the Customer before placing an order and may be saved and printed.

Confirming an order constitutes acceptance of these Terms and Conditions, subject to any mandatory legal provisions protecting consumers.

Purchases made for professional or business purposes may be subject to separate terms and conditions.


3. Products

The jewelry offered on the website is carefully designed, handcrafted, and selected. All products are handmade and may display slight variations from one item to another. These variations are part of their handcrafted and unique character.

Les Bijoux du Nibou makes every effort to present its products as accurately as possible. However, it cannot be held liable for minor differences between product photographs and the actual item, particularly in terms of color, texture, or brightness.


4. Prices

Prices are displayed in euros (€) and include all applicable taxes and VAT.

Any applicable delivery charges are indicated before the order is confirmed.

Delivery is free for orders of €40 or more.

For orders below this amount, delivery charges are payable by the Customer.

Les Bijoux du Nibou reserves the right to change its prices at any time. However, products will be charged at the price displayed when the order is placed.


5. Orders and Conclusion of the Contract

The Customer selects the products they wish to purchase and may review the contents of their shopping cart, quantities, prices, delivery charges, and information entered before confirming the order.

The Customer may correct any errors before submitting the final order.

Immediately before confirming the order, the Customer is provided with a summary including:

  • the essential characteristics of the products;

  • the quantities ordered;

  • the total price, including all applicable taxes;

  • delivery charges;

  • the selected delivery method;

  • the selected payment method;

  • and any applicable delivery restrictions.

Final confirmation of the order creates an obligation to pay. The button used to complete the order includes clear wording informing the Customer of this obligation.

After the order has been placed, an acknowledgment of receipt is sent without undue delay to the email address provided by the Customer.

The order confirmation includes the essential terms of the contract and these Terms and Conditions, or allows the Customer to save them on a durable medium.

Les Bijoux du Nibou may refuse or cancel an order in the event of actual product unavailability, reasonable suspicion of fraud, a payment issue, or an obvious error relating to the price or product description.

When an order is canceled after payment has been received, all amounts paid will be refunded without undue delay.


6. Payment

Payment is due immediately when the order is placed.

Accepted payment methods include:

  • credit and debit cards, including Visa, Mastercard, and Bancontact;

  • bank transfer;

  • other secure payment methods offered on the website.

Payments are processed securely through a certified payment service provider.

Les Bijoux du Nibou does not store the Customer’s banking information.


7. Delivery

Products are delivered to the countries and territories made available during the checkout process.

The available delivery methods, applicable charges, and estimated delivery times are presented to the Customer before the order is confirmed.

For deliveries within Belgium, Les Bijoux du Nibou offers at least two different delivery options, unless a legal exception allows only one delivery option to be offered. When such an exception applies, the objective reason is communicated to the Customer before the order is placed.

The standard order preparation time is two business days. The estimated shipping time is generally three to five business days, depending on the destination and selected delivery method.

The delivery dates or timeframes communicated during checkout constitute the delivery commitment applicable to the order. When no delivery period has been agreed upon, delivery will take place no later than 30 days after the contract is concluded.

When delivery cannot take place within the agreed period, the Customer may request that Les Bijoux du Nibou complete the delivery within an additional period appropriate to the circumstances.

If delivery does not take place within this additional period, the Customer may terminate the contract. The Customer may also terminate the contract immediately when Les Bijoux du Nibou refuses to deliver or when the delivery date was an essential condition of the contract and this requirement had been communicated to the seller.

When the contract is terminated due to failure to deliver, all amounts paid will be refunded without undue delay.

Les Bijoux du Nibou remains responsible for the proper performance of the delivery and bears the risk of loss of or damage to the product until the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the product.

As an exception, when the Customer independently selects a carrier that was not offered by Les Bijoux du Nibou, the risk transfers to the Customer when the product is handed over to that carrier.

Customers are encouraged to report any missing, damaged, or irregular package promptly. However, failure to make an immediate reservation or complaint does not result in the loss of any rights granted by law.


8. Right of Withdrawal

Consumer Customers have a 14-calendar-day right of withdrawal under the conditions set out in Book VI of the Belgian Code of Economic Law.

The conditions, procedures for exercising this right, return shipping costs, refund rules, legal exceptions, and standard withdrawal form are described on the “Return and Refund Policy” page, which forms an integral part of these Terms and Conditions.

The consumer must communicate their decision to withdraw within the statutory period. The consumer then has an additional 14 calendar days to return the products.

The direct cost of returning the products is payable by the consumer, unless Les Bijoux du Nibou agrees to cover it or the consumer was not informed of this cost before placing the order.

The refund includes the price of the products and the initial standard delivery charges. It is issued in accordance with the conditions and timeframes specified in the Return and Refund Policy.


9. Statutory Guarantee of Conformity

Products sold to consumers are covered by the statutory guarantee of conformity provided under Belgian law.

As the seller, ANLOBO SRL is liable for any lack of conformity that becomes apparent within two years of delivery of the product.

When a lack of conformity becomes apparent during this period, it is presumed to have existed at the time of delivery unless proven otherwise or unless this presumption is incompatible with the nature of the product or the nature of the defect.

The consumer must inform the seller of the defect as soon as possible and no later than two months after discovering it.

In the event of a lack of conformity, the consumer is entitled to have the product brought into conformity free of charge through repair or replacement, unless the selected remedy is impossible or would impose disproportionate costs.

Because the creations are handcrafted and sometimes one of a kind, replacement with an identical item may not be possible. In such cases, an appropriate solution will be offered in accordance with applicable law, including repair, replacement with another product accepted by the consumer, a proportionate price reduction, or termination of the contract.

A slight variation in color, shape, texture, or pattern resulting from the handcrafted production process does not necessarily constitute a defect, provided that this characteristic was clearly disclosed before purchase and that the product remains consistent with its description and intended use.

The consumer is encouraged to provide the order number, product reference, a description of the defect, and, where useful, photographs.

Providing photographs may help Les Bijoux du Nibou assess the claim, but photographs are not an absolute requirement for exercising the statutory guarantee.

The statutory guarantee applies independently of any commercial warranty that may also be offered.


10. Liability and Product Safety

Les Bijoux du Nibou is responsible for the performance of its obligations in accordance with applicable law.

Nothing in these Terms and Conditions limits or excludes the consumer’s mandatory legal rights, particularly those relating to:

  • the statutory guarantee of conformity;

  • product safety;

  • the right of withdrawal;

  • delivery;

  • liability for gross negligence or intentional misconduct;

  • or liability for personal injury.

The Customer must follow all instructions for use and care, as well as any safety warnings provided with the product or displayed on its product page.

Subject to mandatory legal provisions, Les Bijoux du Nibou cannot be held liable for damage resulting exclusively from:

  • use that is inconsistent with the product’s stated purpose;

  • failure to follow a safety warning;

  • modification of the product by the Customer;

  • clearly inappropriate care or maintenance;

  • or normal wear and tear.

Any incident, accident, or product safety concern may be reported to:

Where possible, the report should include the product reference, purchase date, nature of the issue, and the circumstances in which it occurred.


11. Personal Data Protection

Personal data collected during the ordering process is used exclusively to process purchases and communicate with the Customer.

In accordance with the General Data Protection Regulation (GDPR), the Customer has the right to access, correct, and delete their personal data at any time by contacting:

12. Intellectual Property

All content available on the website, including text, photographs, logos, images, graphics, and the trade name, is the exclusive property of ANLOBO SRL.

Any reproduction, including partial reproduction, is strictly prohibited without prior written authorization.


13. Applicable Law, Complaints, and Dispute Resolution

These Terms and Conditions are governed by Belgian law.

This choice of law does not deprive consumers residing in another European Union Member State of any mandatory consumer protection provisions available to them under the law of their country of residence.

Les Bijoux du Nibou will acknowledge receipt of the complaint as soon as possible and will make reasonable efforts to find an amicable solution.

When no satisfactory solution can be reached, the consumer may contact:

Using an out-of-court dispute resolution service does not affect the consumer’s right to bring the matter before the competent courts.

If no amicable agreement can be reached, jurisdiction will be determined in accordance with the applicable legal rules.

Nothing in these Terms and Conditions requires the consumer to bring a claim exclusively before the courts having jurisdiction over the seller’s registered office.
